Standing Up for the Vulnerable
No one is more vulnerable than a nursing home resident. Often frail, elderly or disabled, they are easy targets for abuse and neglect.
The attorneys of Darrell L. Castle & Associates stand up for the rights of nursing home residents who have been victims of negligence.
What Is Nursing Home Negligence?
Nursing home abuse and neglect can take many forms, including:
- Falling accidents
- Malnutrition or dehydration
- Bed sores (also called decubitus ulcers or pressure sores)
- Wandering and elopement — when residents become injured after wandering into a dangerous area of the home or leave the campus entirely
- Slapping, hitting, kicking or other forms of physical assault
- Sexual abuse
- Failure to provide access to medical care
- Medication errors, including giving too much, not enough or the wrong medication
- Inadequate staffing
Violating Standards of Care
We will examine your case to determine whether the nursing home violated an established standard of care resulting in harm to a resident. For example, people who are bedridden must be turned every two hours in order to avoid the formation of bed sores. If the nursing home staff failed to meet this standard of care and a resident suffered serious harm because of it, we would file a nursing home negligence claim for damages.
It is a difficult decision to place a loved one in a nursing home. Families only make that decision when they believe their loved one cannot live independently and needs the availability of around-the-clock care.
